I. Scope

The hotel (hereinafter referred to as “Business Hostel”) rents accommodation rooms to the guest for the agreed number of people and for the agreed length of stay. These General Terms and Conditions and Reservation Conditions (GTC) apply to accommodation contracts for the rental of hotel rooms as well as all other services provided to the guest by the Business Hostel.

II. Conclusion of contract

1. The following terms “standard reservation” and “guaranteed reservation” differ in that with a simple reservation the guest only orders a hotel room, while with a guaranteed reservation he also guarantees payment by providing his credit card details. The following term “cancellation” means the guest’s withdrawal from the accommodation contract.

2. If the guest does not show up at the hotel by 6 p.m. for a standard reservation, the reservation expires without replacement and the reserved rooms go on sale. With a guaranteed reservation, the hotel room reservation will be maintained even after 7 p.m. for the guest at a charge.

3. The guest can cancel simple and guaranteed reservations free of charge until 6 p.m. on the day of arrival. Cancellations of guaranteed reservations made after 6 p.m. on the day of arrival are not permitted and do not lead to a termination of the accommodation contract. In this case, the guest remains obliged to pay the accommodation price for the first night. The same applies if the guest does not show up on the day of arrival without canceling his reservation.

4. For guaranteed reservations lasting several days, all subsequent nights from the second night onwards will be canceled in the event of no-show. In principle, the guest is not entitled to the following nights.

5. The provisions in Sections VIII and IX apply to group trips and reservations during trade fairs and events. included special conditions.

6. The reservation and cancellation conditions are the same for all bookings, regardless of whether they are direct or indirect bookings. Direct bookings via our website and telephone bookings with our reception always receive a permanent discount of 5% compared to the online prices.

7. Bookings after 6 p.m. on the same day of arrival are subject to a charge and are binding. In the event of a rebooking or cancellation request, the guest must contact the hotel directly.

IV. Arrival and departure

1. The Business Hostel will provide the guest with the hotel room for the agreed number of people on the day of arrival, subject to availability, usually from 12 p.m. at the earliest, but in no case later than 1 p.m. To access the hotel and the hotel room, the guest usually receives an access code after 11 a.m. via SMS, or the evening before via the booking portal, or when checking in at the reception, or via Whatsapp or directly by telephone.

2. On the day of departure, the guest must vacate his hotel room by 12 p.m. at the latest and return it undamaged. The Business Hostel can then charge the guest 100% of the overnight price for the room’s use beyond the contract due to the late vacating of the room. Regular check-out is at 11am.

V. Terms of Use

1. Only the people named in the reservation are entitled to use the hotel room. The maximum occupancy for the respective room category may not be exceeded. Children count like adults. Babies are not counted.

2. The resale, subletting or subcontracting of booked rooms is prohibited unless otherwise expressly agreed in writing.

3. The guest must adhere to the house rules posted there during their stay in the hotel. Failure to comply may result in increased costs or bans from the hotel.

VI. Accommodation prices and other prices

1. The overnight price to be paid by the guest is the consideration for the provision of the hotel room by the business hostel within the usual arrival and departure times. A full overnight price is charged per night – regardless of the actual use or overnight stay by the guest.

2. The agreed prices apply. The Business Hostel has the right to increase or decrease the accommodation prices if an increase in statutory taxes, fees and charges comes into force between the time of reservation and arrival.

3. The prices or amounts stated in the reservation include the applicable sales tax as well as all statutory taxes, fees and charges. The tourist tax is excluded from this.

VII. Terms of payment

1.The overnight prices as well as the prices for additional services (such as parking space, pet fees and all other claims that are not expressly stated in the accommodation contract as part of the overnight price) are due for payment in advance at the latest upon the guest’s arrival at the hotel, regardless of the date Invoicing. If payment is not made on time, the Business Hostel is entitled to terminate the accommodation contract, whereupon the guest must vacate the room.

2. The Business Hostelist is entitled to demand an advance payment of the accommodation costs from the guest when making the reservation, up to the amount of the expected total invoice amount, or an appropriate security in the form of a deposit using a credit card.

3. The Business Hostel accepts cash in euros, payments by EC, as well as the following credit cards: Visa, Mastercard, Maestro, Diners, Union Pay, V Pay, JCB, Discover and American Express. Online payments via PayPal should be sent to hello@business- hostel.de directed. The name of the person making the booking must be stated. Other means of payment are only permitted with the consent of the Business Hostel. We only offer transfers to companies where costs are covered.

4. The guest can only assert offsetting and retention rights if the underlying counterclaims are undisputed or legally established.

VIII. Special conditions for group travel

1. The following term “group booking” refers to a group of at least 3 full-paying guests with at least 3 rooms to be occupied for whom there is a joint reservation. Deviating from or in addition to the above regulations, the following applies to a travel group:

2. When making the reservation, a contact person (“overall responsible person”) must be named for the travel group at the Business Hostel.

3. Before the travel group arrives, a list of names of all participants must be presented to the Business Hostel.

4. When making a reservation, the person responsible will receive a reservation confirmation from the Business Hostel with the essential details of the reservation made, information about check-in and, if applicable, security deposits and other payment conditions. Reservations from travel groups are always guaranteed reservations.

5. The total amount of the accommodation costs must be paid by bank transfer to the Business Hostel’s bank account specified in the reservation confirmation or notified by the Business Hostel to the person responsible after the reservation has been completed. Fees for international transfers must be paid in full upon arrival at the hotel at the latest.

6. The travel group’s accommodation costs, including costs for additional services, are due for payment in advance, no later than 21 days before the day of arrival, or, if the reservation is made later than 21 days before the day of arrival, immediately, regardless of the date of invoicing. The booking must be secured by providing a valid credit card. If the travel group or the respective guest does not pay the accommodation costs when due, the BusinesHostel reserves the right to charge the specified credit card in the amount of the overnight costs owed. If no payment has been made by the due date or if the credit card provided cannot be charged, the Business Hostel is entitled to rent the hotel room reserved for the travel group or the respective guest to someone else (without prior information to the guest) without the guest having any consequences can derive claims against the Business Hostel.

7. The travel group can cancel or change their reservation free of charge up to 21 days before the day of arrival. Later cancellations and changes are only possible with the consent of the hotel and payment of a cancellation fee.

8. The Business Hostel will make its hotel rooms available to the travel group on the day of arrival subject to availability, usually from 1:00 p.m., but in no case later than 3:00 p.m.

9. When the travel group arrives at the hotel, the Business Hostel is entitled to provide a security of up to € 500 per travel group, in particular for any additional services within the meaning of Section VII.1. as well as to claim any damage from the person responsible overall.

10. The travel group receives collective invoices from the Business Hostel, which are handed over to the person responsible.

11. If events, trade fairs or events do not take place, see IX. 5th & 6th.

IX. Special conditions for trade fair and event times

1. The Business Hostel will inform the guest about trade fair and event times at any time upon request, at the latest when making the reservation. Deviating from or in addition to the above regulations, the following applies to trade fair and event times:

3. The payment conditions in section VIII.6. apply accordingly. Section VIII.7 applies to cancellations and changes to the length of stay, the room category or the number of rooms. accordingly.

4. Refunds of payments made for group trips are excluded for trade fair and event times.

5. Furthermore, the hotel is entitled to withdraw from the contract for objectively justified reasons, for example if

6. If the hotel withdraws with justification, the customer has no right to compensation.

X. Liability of the Business Hostel

1. The Business Hostel is liable for damages resulting from injury to life, body or health for which it is responsible. Furthermore, the Business Hostel is liable for other damages that are based on an intentional or grossly negligent breach of duty by the Business Hostel or on an intentional or negligent breach of essential contractual obligations by the Business Hostel. Essential contractual obligations are those that enable the proper execution of the contract and on whose fulfillment the guest trusts and may rely. A breach of duty by Business Hostel is equivalent to that of a legal representative or vicarious agent. Further claims for damages are excluded, unless otherwise regulated in this Section X.

2. If disruptions or deficiencies occur in the Business Hostel’s services, the Business Hostel will endeavor to remedy the situation upon knowledge or immediate complaint from the guest. The guest is obliged to do what is reasonable to remedy the disruption and keep any possible damage to a minimum.

3. The Business Hostel is liable to the guest for items brought in in accordance with the statutory provisions. If the guest wishes to bring money, securities and valuables with a value of more than €1,000 or other items with a value of more than €2,000 into the hotel, this requires a separate storage agreement with the hotel.

4. If the guest is provided with a parking space in the hotel garage or in the hotel parking lot, even for a fee, this does not constitute a storage contract. The Business Hostel is not liable if motor vehicles parked or maneuvered on the hotel property and their contents are lost or damaged.

5. Messages, mail and shipments of goods for guests are handled with care.

XI. Theft and damage

In the event of theft or damage to their belongings, as well as in the event of fire, water damage or other damage to the hotel room, the guest must immediately inform the hotel staff and do everything reasonable to investigate the theft or repair the damage can be helpful

XII. Pets

Bringing dogs and cats (hereinafter referred to as “pets”) requires prior notification by the guest; For other animals, please contact the Business Hostel with the exact species name; in all cases, consent can be refused at any time and without giving reasons. A maximum of one pet can be brought per single room and two pets per double room. An additional fee must be paid for each pet brought along, the amount of which the Business Hostel will inform the guest upon notification. The Business Hostel can subsequently adjust the fee if the level of contamination caused by the pet makes this necessary.

XIII. Termination of the accommodation contract

1. The Business Hostel is entitled to withdraw from the accommodation contract if the guest does not make an advance payment owed by him and/or a deposit owed by him on time or in full.

2. The Business Hostel is entitled to terminate the accommodation contract if the guest is under the influence of illegal drugs during his stay in the hotel, uses the hotel room to carry out a commercial activity with customer traffic, uses the hotel room for prostitution, hotel staff or others Despite warnings, hotel guests are repeatedly insulted, deliberately cause harm or excessively ignore the house rules.

XIV. Data protection

1. The guest is advised that their personal data will only be stored and processed by the Business Hostel for the purpose of executing the contract. Data will only be transmitted to companies affiliated with the Business Hostel and selected third-party service providers as part of the usual hotel-typical administration processes. The Business Hostel is entitled to use affiliated companies and selected third-party service providers to carry out data processing to the extent necessary and to forward personal data to these companies in accordance with this section and to have it stored and processed by them.

2. Personal data will not be used for advertising purposes.

3. Furthermore, the guest’s rights to information, correction, blocking or deletion of their personal data stored by the Business Hostel remain unaffected. Unless there are legal regulations to the contrary, the guest’s personal data will be deleted after the accommodation contract has ended and the statutory retention periods have expired.

XV. General Provisions

1. Changes and additions to the accommodation contract, the acceptance of the application or these general terms and conditions must be in text form. Unilateral changes or additions by the guest are invalid.

2. Any ineffectiveness of one or more of the above provisions does not affect the effectiveness of the remaining provisions.

3. The law of the Federal Republic of Germany applies exclusively.

4. Place of jurisdiction is Wiesbaden. However, the Business Hostel is entitled to bring lawsuits and other legal proceedings at the guest’s general place of jurisdiction.
